Reflexões sobre a Lei 13.718/18 : uma análise dos crimes sexuais sob a luz da evolução do bem jurídico protegido pelo Título VI da Parte Especial do Código Penal

Abstract

Esse trabalho destina-se a realizar uma análise crítica da Lei nº 13.718 de 2018, responsável pela alteração de dispositivos do Título VI da Parte Especial do Código Penal Brasileiro (dos Crimes Contra a Dignidade Sexual). Essa lei trouxe novos tipos penais e alterou figuras relevantes para o sistema penal, como exemplo a modalidade de ação penal a ser utilizada para a persecução penal dessas infrações. Pretende-se traçar comentários à referida lei tendo em vista a evolução do bem jurídico tutelado nos crimes sexuais, partindo-se do pressuposto de que ele está (e deve continuar) em constante evolução. O presente trabalho busca ainda justificar a necessidade de se garantir a plena e efetiva realização de valores como a igualdade e dignidade da pessoa humana em relação às vítimas dessa classe de delitos, o que atualmente não ocorre. Principalmente ao considerar que mulheres são as principais vítimas de tais crimes, o que se justifica, dentre outros motivos, pelo domínio de uma cultura machista presente na sociedade brasileira, que tenta, muitas vezes, encontrar justificativas para imposição da vontade masculina no âmbito social. Assim, busca-se realizar uma reflexão plena acerca dos motivos que levaram à edição da Lei nº 13.718, relacionando-a com as mudanças sociais que a influenciaram. A pesquisa visa a responder como e em qual grau de medida a Lei nº 13.718 contribuiu para concretização legislativa da evolução do bem jurídico tutelado pelos crimes contra a dignidade sexual.

This work aims to carry out a critical analysis of Law 13.718 / 2018, which aims to change the provisions of Title VI of the Brazilian Penal Code (Crimes Against Sexual Dignity). This law brought new penal types and changed important points in the penal system, such as the type of criminal action to be used to prosecute these offenses. The research traces comments to the referred law aiming at the evolution of the legal good related to sexual crimes, starting from the assumption that it is (and must continue) in constant evolution. The present work also seeks to justify the need to guarantee the full and effective realization of values such as the equality and dignity of the human person, which currently does not occur. Especially when considering that women are still the main victims of such crimes. This is explained, among other reasons, by the dominance of a sexist culture in Brazilian society, which often tries to find justifications for male imposition in the social sphere. Thus, we seek to carry out a full reflection on the reasons that led to the enactment of Law 13.718, relating it to the social changes that influenced this process. Therefore, the research seeks to answer how and how much the Law 13.718 contributed to the legislative implementation of the evolution of the legal good related to crimes against sexual dignity.
