Atuação policial, discriminação e direitos humanos: análise dos julgados da Corte Interamericana de Direitos Humanos

Abstract

O artigo busca responder em que medida as atuações policiais relacionam-se à discriminação, de modo a caracterizar violações do direito internacional dos direitos humanos. A pesquisa é de caráter qualitativo, mediante revisão bibliográfica, dos estudos sobre discriminações/estigmatizações e sobre o conceito de subcidadania. Soma-se a isso a análise de três casos recentes julgados na Corte Interamericana de Direitos Humanos (CIDH) que versam sobre a atuação policial. No primeiro caso, tem-se a atuação policial nas favelas brasileiras, com enfoque em execuções ocorridas na Favela Nova Brasília. Nesse caso, a Corte apontou considerações relevantes sobre a indeterminação dos autos de resistência, que leva a mortes nunca propriamente investigadas. No segundo caso, aparece a violação de direitos humanos pela existência de perfis raciais na atuação policial. O terceiro caso observa a fundada suspeita, o olfato policial, como uma violação de direitos humanos. Por fim, verifica-se que um dos principais fatores que permitem essa forma de violação dos direitos humanos dos alvos preferenciais das atuações policiais é o de viver em um Estado que permite que existam cidadãos e subcidadãos. É preciso, junto com a mudança legislativa, educar os agentes policiais em direitos humanos, rever a mentalidade da guerra às drogas e da cultura de controle, e pensar nos fatores de gênero, classe, completude física, território e, principalmente, raça, como influenciadores das instituições e dos indivíduos, a fim de remodelar estruturalmente as relações sociais e a atuação estatal.

The article aims to answer the extent to which police actions are related to discrimination, in a way that characterizes human rights violations. The research is qualitative, through a bibliographic review of studies on discrimination/stigmatization and on the concept of subcitizenship. In addition, three very recent cases tried in the Inter-American Court of Human Rights (IACHR) that deal with police action are analyzed. In the first case, the police action in the Brazilian favelas is under examination, and the Court deals with executions that occurred in the Favela Nova Brasília. In this case, the IACHR highlighted relevant considerations about the indetermination of the resistance records, which leads to deaths never properly investigated. In the second case, there is the violation of human rights by the existence of racial profiles in police action and the third case observes the well-founded suspicion, police sense of smell, as a violation of human rights. Finally, it is verified that one of the main factors that allow this way of violating preferred targets of police actions’ human rights is living in a state that permits citizens and subcitizens to exist. It is necessary, together with legislative change, to educate police officers in Human Rights, to review the mentality of the war on drugs and the culture of control, and to think about the factors of gender, class, physical completeness, territory, and, mainly, race, as influencers of institutions and individuals, to structurally reshape our society
