O reformismo normativo bourbônico espanhol : uma via alternativa para a modernidade jurídica?

Abstract

O artigo apresenta uma releitura do reformismo normativo bourbônico espanhol como estratégia típica do séc. XVIII para estabelecer o direito vigente nos domínios da Coroa de Espanha. Mesmo tendo em conta os elementos do casuísmo que advinham de período anterior, os Bourbon definiram um sistema novo que se apresentou nas compilações legis-lativas da época, entrando inclusive no início do séc. XIX, com diferenças ante o modelo francês de código (do mos geometricus). Por fim, demonstra a relevância de fazer-se a distinção entre dois conceitos de Modernidade jurídica, uma radical e outra moderada.

The article presents a rereading of spanish bourbonesque normative reformism as a typical strategy of the 18th cen-tury to establish the rule of law in the areas of the Crown of Spain. Even taking into account the elements of casuism that came from the previous period, the Bourbon defined a new system that was presented in the legislative compilations at the time, even entering the beginning of the 19th century presenting differences with the French code model (the mos geometricus). Finally, it shows the relevance of distinguish-ing between two concepts of legal Modernity, one radical and the other moderate.
