Os conflitos da CUT com a estrutura sindical brasileira : avanços e entraves na luta dos trabalhadores brasileiros

Abstract

Este trabalho investiga a relação da Central Única dos Trabalhadores (CUT) com a estrutura sindical brasileira, tal estrutura resume-se em alguns pontos, a saber: unicidade sindical, imposto sindical em conjunto com demais taxas compulsórias e poder normativo da Justiça do Trabalho. O objetivo central do trabalho consistiu em compreender as principais dificuldades da CUT no combate a estrutura sindical ao longo de sua trajetória, da sua fundação na década de oitenta até a atualidade. Para realizar esse objetivo, primeiro descrevemos o histórico de implementação da estrutura sindical, logo após analisamos o posicionamento da CUT com a estrutura sindical e por fim examinamos suas ambiguidades ideológicas em relação ao combate a essa estrutura. Como metodologia de pesquisa utilizamos uma pesquisa documental por meio das resoluções de congressos e plenárias da CUT. Também foram utilizadas entrevistas já realizadas com dirigentes do âmbito nacional dessa central, somados a dados do DIEESE e IBGE. Em nossa hipótese, quanto maior a participação da CUT no Estado burguês e na estrutura sindical, esses fatores em conjunto com sua ideologia legalista imputam a crença em seus dirigentes nacionais sobre a existência de “elementos positivos” nessa estrutura. A partir disso a central aceita a tutela do Estado burguês nos assuntos relacionados as atividades sindicais, como contribuições compulsórias, unicidade sindical e Justiça do Trabalho. A análise dos dados confirmou a existência do legalismo sindical na CUT. A partir disso concluímos que a estrutura sindical existe, devido tanto ao Estado burguês e sua estrutura cerceadora aos sindicatos por meio de um corpo estrutural normativo, como pela ideologia dos aparelhos ideológicos de Estado, reprodutores da ideologia burguesa que influem na ideologia da CUT. Diante disso, a central com base em sua ideologia legalista é impedida de realizar um movimento dos trabalhadores independente do Estado burguês.

The work investigates the relationship of the Central Única dos Trabalhadores (CUT) with the Brazilian union structure, such structure is summarized in some points, namely: union unity, union tax in conjunction with other compulsory fees and normative power of the Labor Justice. The main objective of the work was to understand the main difficulties of the CUT in combating the union structure throughout its trajectory, from its foundation in the eighties to the present. To achieve this objective, we first describe the history of implementing the union structure, then we analyze the positioning of the CUT with the union structure and also its ideological ambiguities in relation to combating this structure. As a research methodology we use a documentary research through the resolutions of congresses and plenary sessions of the CUT. Interviews already carried out with leaders from the national scope of this center were also used, added to data from DIEESE and IBGE. In our hypothesis, the greater the participation of the CUT in the bourgeois state and in the union structure, these factors, together with its legalistic ideology, imputes the belief in its national leaders about the existence of “positive elements” in this structure. to accept the tutelage of the bourgeois state in matters related to union activities, such as compulsory contributions, union unity and labor justice. Data analysis confirmed the existence of union legalism in the CUT. From this we conclude that the union structure exists, due to the bourgeois state and its structure surrounding the unions through a normative structural body, such an instrument through its ideological apparatus, reproducing the bourgeois ideology, influences the CUT ideology. Given this, the central through its legalistic ideology is prevented from carrying out a workers' movement independent of the bourgeois state.
