Free Shops em São Borja-RS : marcos legais e condicionantes sanitários

Abstract

Este trabalho estuda o processo recente de implantação do Free Shop em São Borja. Complementando o decreto - lei nº 1.455/1976, a lei nº 12.723 de 2012 autorizou a instalação das lojas francas em municípios fronteiriços classificados como cidades - gêmeas, com o objetivo de impulsionar o setor turístico, promovendo a circulação de capital n a faixa de fronteira e, consequentemente, seu desenvolvimento. A pesquisa em questão é contextualizada por uma realidade anômala introduzida pela chegada do Coronavírus ao Brasil no início de 2020, a qual trouxe consigo mudanças significativas para a econo mia brasileira. O estudo explora os conceitos de free shop e cidade - gêmea sob a perspectiva da Geografia Econômica. Possui o objetivo de indagar sobre a relevância dos acréscimos previstos na constituição da lei nº 12.723/2012 em um estudo de caso no munic ípio de São Borja, onde a loja franca Brasil Free Shop foi inaugurada em 23 de março de 2021, considerando que o setor turístico foi gravemente afetado pelo fechamento da fronteira. Por fim, com base nos dados coletados, a investigação sugere que a lei nº 12.723/2012 concede benefícios extravagantes para os empreendimentos Duty Free. O trabalho verifica em saída de campo que as restrições para o público em relação à compra de mercadoria importada nos Free Shops em cidades - gêmeas são ou dúbias em sua legislação ou não estão sendo seguidas.

This work studies the recent process of setting up Free Shops in Brazilian twin cities, t in the frame of Law No. 12,723 in 2012, which authorized, in addition to Decree - Law No. 1,455 / 1976, the installation of duty - free stores in border cities classified as twin cities, with the objective of developing fostering the tourism sector, promoting the cir culation of capital in the border strip and, consequently, its development. This research is carried out in an anomalous reality introduced by the arrival of the Coronavirus in Brazil in early 2020, which brought with it significant changes for the Brazilian economy. Considering the economic crisis faced by Brazilian companies - especially medium and small ones - during the pandemic period, together with the closing of the Brazilian border with Argentina, it is interesting to observe that Duty Free s tores continue with its implantation and inauguration processes. The study explores the concepts of free shop and twin city from the perspective of Economic Geography. It examines the additions to the constitution linked to Law No. 12,723 / 2012. Its case study is in the municipality of São Borja, where the Brazil Free Shop was opened on March 23, 2021. The implantation took place after postponements, but still during the pandemic period, when there were no expectations for the establishment of duty - free st ores in twin cities bordering Argentina. Finally, based on the events, the investigation seeks to verify whether Law No. 12,723 / 2012 grants unusual benefits to Duty Free ventures. The work also verifies that the restrictions for the public in relation to the purchase of imported merchandise in Free Shops in twin cities are either dubious in its legislation or are not being followed.
