Os casos de violação de direitos de crianças e adolescentes na pandemia do coronavírus : uma aproximação no Conselho Tutelar de Porto Alegre

Abstract

A pandemia da COVID-19 estabeleceu medidas emergenciais de isolamento social perante o crescimento exponencial no número de infectados e mortos pela doença no Brasil, e a complexidade dos impactos causados pela crise sanitária mostraram-se desafiadores. Na vida das crianças e adolescentes, os efeitos diretos e indiretos geram preocupação. Embora tenham sido encontradas alternativas para contornar o fechamento das escolas, em situações onde há carência de acesso à tecnologia, por exemplo, o desenvolvimento e integração social do indivíduo são prejudicados. Ademais, outro dado preocupante é apresentado neste contexto: segundo o Governo Federal, 8 a cada 10 casos de violência à crianças e adolescentes acontecem dentro de suas próprias casas, e a estimativa aponta que 7 ocorrem diariamente. Paralelamente, o número de denúncias reduziu significativamente, o que pode estar relacionado ao afastamento das crianças de ambientes de proteção, tais como escola, onde os profissionais percebem sintomas de violência e denunciam as suspeitas das violações. Tendo em vista a eminente situação de vulnerabilidade acerca da realidade enfrentada pelas crianças, pesquisa-se sobre os aspectos dos casos notificados de violação de direitos de crianças e adolescentes durante a pandemia ao Conselho Tutelar de Porto Alegre. O estudo se restringe aos bairros Rubem Berta, Jardim Leopoldina, Passo das Pedras/Vila Operária, Costa e Silva, Parque Santa Fé e Mário Quintana; a fim de identificar o panorama atual da violência infantil na região. Para tanto, fez-se a revisão sobre a concepção da infância na sociedade; levantamento das principais características das violações de direitos infanto-juvenis na região nesse período, análise de possíveis transformações nos aspectos das transgressões durante a pandemia. Realiza-se, então, uma pesquisa qualitativa exploratória no Conselho Tutelar, onde as informações foram coletadas por meio da revisão bibliográfica e levantamento documental de denúncias, atendimentos e expedientes, além de questionário aos Conselheiros Tutelares. Diante disso, verifica-se que os pais e responsáveis são atores sociais predominantes nos casos como agentes violadores, e a negligência é o tipo de violência mais presente nas notificações, sobretudo na área da educação, por parte da família e Estado.

The pandemic of COVID-19 established emergency measures of social isolation in face of the exponential growth in the number of infected and dead from the disease in Brazil, and the complexity of the impacts caused by the health crisis proved challenging. In the lives of children and adolescents, the direct and indirect effects generate concern. Although alternatives have been found to circumvent the closing of schools, in situations where there is lack of access to technology, for example, the development and social integration of the individual are harmed. Moreover, another worrying fact is presented in this context: according to the Federal Government, 8 out of 10 cases of violence against children and teenagers happen inside their own homes, and it is estimated that 7 occur daily. At the same time, the number of reports has significantly reduced, which maybe related to the removal of children from protective environments, such as schools, where professionals notice symptoms of violence and report suspected violations. In view of the eminent situation of vulnerability about the reality faced by children, we researched the aspects of the cases reported of violation of the rights of children and adolescents during the pandemic to the Guardianship Council of Porto Alegre. The study is restricted to the neighborhoods Rubem Berta, Jardim Leopoldina, Passo das Pedras/Vila Operária, Costa e Silva, Parque Santa Fé and Mário Quintana; in order to identify the current panorama of child violence in the region. To do so, a review was carried out on the conception of childhood in society; a survey of the main characteristics of the violations of children's rights in the region during this period, and an analysis of possible changes in the aspects of transgressions during the pandemic. A qualitative exploratory research is then carried out at the Guardianship Council, where the information was collected through a bibliographic review and a documentary survey of complaints, services and files, in addition to a questionnaire to the Guardianship Councilors. Therefore, it is verified that parents and guardians are the predominant social actors in the cases as violent agents, and neglect is the type of violence most present in the notifications, especially in the area of education, by the family and the State.
