A relação entre o Estado e religião na Filosofia do Direito de Hegel

Abstract

Busca-se estudar a relação entre o Estado hegeliano e a religião, suas interações e os eventuais conflitos que podem ocorrer. É oferecida uma leitura que liga o saber teológico com o saber filosófico, proporcionado por Kervégan, assim como a leitura de um trecho de Siep que questiona o quão moderno é o Estado hegeliano, com foco específico no secularismo. A tentativa é de investigar os limites da filosofia hegeliana (como determinações do tempo) com a intenção final de mostrar que tais limites não são meros pontos contra ou a favor da filosofia, mas que o espírito filosófico reside no explorar da racionalidade, e que deixar o movimento filosófico de um dado tempo sem contestação vai contra o que toda a filosofia é. Ao se apontar vieses ou não, a filosofia hegeliana é de grande relevância, fornecendo-nos material teórico para justificação da instituição política que é o Estado e a garantia de sua independência a partir da sua fundamentação racional. Ao concluir, mostra-se que a relação entre Estado e religião fica claramente estabelecida no §270.

It is the goal to study the relation between the hegelian State and religion, their interactions and eventual conflicts that might occur. It is offered the reading that links Hegel’s teological knowledge with his philosophical one, suggested by Kervégan, and the reading of a piece of Siep’s work which asks rather how modern is the hegelian State, specifically when it focuses on secularism. It is attempted to investigate Hegel’s philosophy limits (as if it is something determined in said time) intending to show that its limits aren’t simply localized right or wrongdoings of his philosophy, but it is within the philosophical spirit the rational exploration, and to let the philosophical movement in a given time without contesting it goes against what philosophy is. Whether pointing biases or not, Hegel’s philosophy is of great relevance still, still offering us theoretical material to justify the political institution that is the State, and assure its independance by a rational groundwork. To conclude, it is shown that the relation of State and reigion is clearly established in the §270.
