Os efeitos da interferência judicial em políticas públicas estudo de caso : Fundação de Proteção Especial do Rio Grande do Sul

Abstract

Este trabalho é um estudo de caso, está inserido no campo de estudos sobre Judicialização de Políticas Públicas no Brasil e tem como objetivo identificar os efeitos da interferência judicial na Fundação de Proteção Especial do Rio Grande do Sul (FPERGS). O estudo foi elaborado por meio de observação em campo, revisão bibliográfica, análise documental e entrevistas. Por meio dele foi possível observar que a provocação do Poder Judiciário pelo Ministério Público Estadual para garantir os direitos das crianças e adolescentes produziu transformações na execução do serviço de acolhimento institucional da FPERGS. Como resultado da pesquisa, identificamos que os efeitos da interferência judicial na Fundação foram: mudanças envolvendo o perfil do público-alvo atendido; sobrecarga aos funcionários; letargia na efetivação dos direitos das crianças e dos adolescentes; janela de oportunidade para o governo atuar na situação dos adultos com deficiência atendidos.

This research is a case study, inserted in the field of studies on Public Politicies Judicialization in Brazil and aims to identify the effects of judicial interference at the Fundação de Proteção Especial do Rio Grande do Sul (FPERGS). The study was carried out through field observation, bibliographic review, documental analysis and interviews. Through it, it was possible to observe that the provocation of the Judiciary Power by the State Prosecutor to guarantee the rights of children and adolescents produced transformations in the execution of the institutional reception service of FPERGS. As a result of the research, we identified that the effects of judicial interference in the Foundation were: changes involving the profile of the target audience served; overloading employees; lethargy in the realization of the rights of children and adolescents; window of opportunity for the government to act on the situation of adults with disabilities served.
