Aumento da proteção a propriedade intelectual sob a ótica das relações internacionais : a construção do Acordo Trips sob a liderança estadunidense

Abstract

A presente monografia parte da seguinte pergunta de pesquisa: como a vertente teórica institucionalista neoliberal das Relações Internacionais explica a pressão estadunidense por maior proteção à propriedade intelectual no âmbito do comércio internacional a partir da década de 80? Tal indagação parte das hipóteses de que (1) as mudanças ocorridas na economia e política mundiais entre as décadas de 1980 e 1990 levaram a ascensão da demanda pela proteção da propriedade intelectual a nível internacional e (2) Os Estados Unidos e multinacionais americanas tinham interesse na construção de um regime internacional que tivesse como objetivo a manutenção da superioridade econômica do país, dadas as circunstâncias do período e as novas dinâmicas inauguradas a partir de então. A partir de tal indagação, objetiva-se compreender como se operacionalizou a construção da atual regulação internacional para propriedade intelectual inaugurada com a assinatura do Acordo TRIPS, a partir da perspectiva teórica institucionalista neoliberal das relações internacionais. Para atingir tal objetivo, buscou-se (i) identificar a relação entre propriedade intelectual e comércio internacional, e os principais debates em torno da interconexão entre os temas; (II) identificar como se operacionalizou a construção da agenda estadunidense para propriedade intelectual, os principais atores envolvidos e sua influência sobre a construção da agenda internacional para propriedade intelectual na década de 1980; e (iii) analisar, por fim, se a proposta estadunidense foi contemplada a partir da análise das principais características e mudanças inauguradas no sistema de propriedade intelectual com a assinatura do Acordo TRIPS. A partir do levantamento bibliográfico sobre as questões mencionadas e análise sobre os fatores do assunto, constata-se que a agenda multilateral para propriedade intelectual inaugurada com a assinatura do Acordo TRIPS reflete em grande medida as demandas levantadas pelos Estados Unidos e suas empresas multinacionais.

The monograph that follows is based on the following research question: how does the neoliberal institutionalist theoretical strand of International Relations explain US pressure for greater protection of intellectual property in international trade since the 1980s? This question is based on the hypotheses that (1) the changes that took place in the world economy and politics between the 1980s and 1990s led to a rise in demand for the protection of intellectual property at international level and (2) the United States and American multinationals had an interest in building an international regime to maintain the country's economic superiority given the circumstances of the period and the new dynamics that were inaugurated from then on. Based on this question, the aim is to understand how the current international regulation of intellectual property, inaugurated with the signing of the TRIPS Agreement, was constructed from the theoretical perspective of neoliberal institutionalism in international relations. In order to achieve this objective, we sought to (i) identify the relationship between intellectual property and international trade and the main debates surrounding the interconnection between these issues; (II) identify how the American agenda for intellectual property was constructed, the main players involved and their influence on the construction of the international agenda for intellectual property in the 1980s; and (iii) finally, analyze whether the American proposal was taken into account based on an analysis of the main characteristics and changes inaugurated in the intellectual property system with the signing of the TRIPS Agreement. Based on a biographical survey of the issues mentioned and an analysis of the factors involved, it can be seen that the multilateral agenda for intellectual property inaugurated with the signing of the TRIPS Agreement largely reflects the demands raised by the country and its multinational companies.
