A proteção internacional dos Direitos Humanos e o caso Lula no Comitê de Direitos Humanos

Abstract

O artigo explora o funcionamento dos órgãos dos tratados junto ao sistema universal de proteção aos Direitos Humanos das Nações Unidas a partir da atuação do Comitê de Direitos Humanos. O Comitê de Direitos Humanos monitora a adesão dos Estados Partes ao Pacto Internacional sobre Direitos Civis e Políticos, do qual o Brasil é signatário. O objetivo principal consiste em verificar os impactos jurídicos da decisão do Comitê no caso do ex-presidente Luiz Inácio Lula da Silva, cuja decisão foi adotada em 2022. Os objetivos específicos referem-se a examinar os direitos fundamentais violados e garantidos no Pacto Internacional sobre Direitos Civis e Políticos, que ensejaram a demanda; e, por fim analisar a decisão e seus possíveis impactos. O estudo conclui que que os impactos jurídicos da decisão do Comitê de Direitos Humanos são limitados, uma vez que não existem mecanismos que obriguem de forma efetiva os países a adotarem as recomendações feitas pelo órgão. A metodologia adotada é analítica indutiva, por meio da técnica de pesquisa bibliográfica e documental.

The article explores the functioning of the treaty bodies within theuniversal system for the protection of Human Rights of the United Nations from the point of view of the Human Rights Committee. The Human Rights Committee monitors the adherence of States Parties to the International Covenant on Civil and Political Rights, to which Brazil is a signatory. The main objective is to verify the legal impacts of the Committee's decision in the case of former President Luiz Inácio Lula da Silva, whose decision was adopted in 2022. The specific objectives refer to examining the fundamental rights violated and guaranteed in the International Covenant on Civil and Political Rights, which gave rise to the demand; and, finally, analyze the decision and its possible impacts. The study concludes that the legal impacts of the Human RightsCommittee's decision are limited, since there are no mechanisms that effectively oblige countries to adopt the recommendations made by the Committee. The adopted methodology is inductive analytical, through the technique of bibliographic and documental research.
