Mulher e família no processo constituinte de 1988

Abstract

Este trabalho pretende analisar como se configura a cidadania da mulher brasileira a partir do recente processo de elaboração de normas legais sobre a família. Para tal, são analisados os discursos referentes à mulher e à família, dos congressistas que elaboraram a Constituição Brasileira de 1988, utilizando-se os conceitos de direito, cidadania, e gênero, como categorias analíticas. Os dados encontrados indicam que a família monogâmica, nuclear e estruturada a partir das diferenças entre os sexos é identificada como uma organização natural. Essa organização é o sujeito de direito para os parlamentares, e não a mulher. Nesse sentido, as reivindicações de direitos femininos são incorporados à legislação no intuito de manutenção da estrutura familiar. Frente a isso, discute-se a cidadania feminina enquanto uma cidadania concedida, construída na contradição entre proteção- direito e entre centralidade- subordinação da mulher na família. Ao final do trabalho, junto às conclusões, indica-se possibilidades de continuidade do estudo.

This work intends to analyze how the Brazilian woman citizenship takes form from the recent process elaboration of legal norms about the family. To do this, are analyzed the speeches of the congressmen who elaborated the 1988 Brazilian Constitution, concerning the woman and family, using concepts of right, citizenship and gender, as analytical categories. The found data indicate that the monogamic, nuclear and gender structured family is identified as a natural organization . To the congressmen, this organization, and not the woman, is the subject of right. In this sense, the feminine right's revindications are incorporated to the legislation for the family structure maintenance purpose. Therefore, it is discussed the feminine citizenship as an allowed citizenship, built up on the contradiction between protection I right and centricity I subordination of the woman in the family. At the end of the work, attached to the conclusions, are suggested possibilities to this study continuity.
