A guarda compartilhada e a evolução das decisões judiciais do TJRS nos últimos 10 anos

Abstract

A presente monografia analisa o instituto da guarda compartilhada, destacando as suas características e as diferenças entre os demais modelos de guarda: a guarda unilateral, a guarda alternada, a guarda nidal e outras demais modalidades. A guarda alternada não está mais vigente no ordenamento jurídico desde 2014, porém ainda continua sendo amplamente difundida ou aplicada na jurisprudência como semelhante ao tema central deste trabalho de conclusão, o que é um erro crucial. Além dos modelos de guarda existentes e as suas distinções principais, este trabalho tem como intuito investigar como a jurisprudência do Tribunal de Justiça do Rio Grande do Sul tem aplicado à guarda compartilhada nestes últimos 10 anos, ou seja, desde um ano antes da publicação da Lei n. 11.698/2008, passando pelas mudanças introduzidas pela Lei n.13058/2014, até o presente momento, ano de 2017. Nesse sentido, a pesquisa bibliográfica realizou-se tanto por meio de doutrina psicojuridica, quanto por análise percentual e gráfica das decisões judiciais do TJRS. O objeto primordial desse trabalho é concluir se ocorreram mudanças significativas e quais foram elas, desde 2007 até 2017, no que tange à aplicação prática dos casos de guarda compartilhada julgados pelo Egrégio Tribunal, muitos deles envolvendo atributos inerentes ao poder familiar, como a obrigação alimentar. Portanto, diante da análise de todas as metodologias, principalmente as gráficas, conclui-se que houve muitos avanços nas decisões envolvendo guarda compartilhada e alimentos, principalmente com relação ao deferimento ou manutenção desse modelo de guarda, mesmo que não exista consenso entre os genitores.

This monograph analyzes the institute of shared guard, highlighting its characteristics and the differences between the other models of guard: unilateral guard, alternate guard, guard and other modalities besides. Alternate custody is no longer in force in the legal system since 2014, but is still widely disseminated or applied in jurisprudence as similar to the central theme of this conclusion work, which is a crucial error. In addition to existing custody models and their main distinctions, this paper aims to investigate how the jurisprudence of the Court of Justice of Rio Grande do Sul has applied shared custody in the last 10 years, that is, one year before the publication of the Law number 11,698 / 2008, going through the changes introduced by Law number 13058/2014, up to the present moment, in 2017. In this sense, the bibliographic research was carried out both by means of psycho-juridical doctrine and by a percentage and graphical analysis of the judicial decisions of the TJRS. The main object of this work is to conclude if significant changes occurred and what were they, from 2007 to 2017, regarding the practical application of shared custody cases judged by the High Court, many of them involving attributes inherent to family power such as food obligation Therefore, in view of the analysis of all the methodologies, especially the graphs, it was concluded that there were many advances in the decisions involving shared custody and food, especially regarding the deferment or maintenance of this custody model, even though there was no consensus among the parents .
