A legalização da mineração na tribo indígena cinta larga um caminho necessário?

Abstract

A presente tese investiga, por meio do método indutivo, pesquisa bibliográfica, documental e de campo, os conflitos e dificuldades vivenciados pela comunidade Cinta Larga. Tal situação decorre de duas décadas de exploração ilegal de diamantes em suas terras, perpetradas por garimpeiros, diversos problemas em suas relações com o Governo Federal e demais órgãos estatais responsáveis pela tutela jurídica dos direitos legais da referida comunidade. Busca-se compreender a complexidade que envolve a mineração diamantífera na história do povo Cinta Larga até a atual situação vivenciada pela comunidade frente à exploração garimpeira. Analisou-se, de forma pontual, dez anos de atuação do Ministério Público Federal, no interstício de 2004 e 2013, no garimpo ilegal na comunidade pesquisada, após uma massacre mundialmente divulgado que ocorreu no ano de 2004. Buscou-se compreender, porque mesmo com o massacre de 2004, ainda que com a pressão do MPF, o Governo Federal não foi capaz de paralisar a atividade ilegal de mineração que ocorre naquela comunidade? Após isso, fez-se pesquisa de campo para entender a situação atual da mineração na comunidade, e verificar quanto a possibilidade de se legalizar a mineração na tribo, e caso ela venha a ser legalizada, quem deveria executar a mineração, os índios ou terceiros? Colheu-se, alfim, que legalização da mineração e a compatibilização da exploração mineral com a preservação cultural e étnica da tribo Cinta Larga é um assunto dotado de relativa complexidade, devendo a comunidade indígena ser ouvida em todos os passos, antes de se decidir acerca legalização da exploração de diamantes.

This thesis investigates, through the inductive method, bibliographic, documentary and field research, the conflicts and difficulties experienced by the Cinta Larga community. This situation stems from two decades of illegal diamond mining on their lands, perpetrated by gold miners, several problems in their relations with the Federal Government and other state bodies responsible for the legal protection of the legal rights of that community. It seeks to understand the complexity that involves diamond mining in the history of the Cinta Larga people up to the current situation experienced by the community in the face of gold mining. It was analyzed, in a punctual way, ten years of activity of the Federal Public Ministry, in the interstice of 2004 and 2013, in illegal mining in the researched community, after a worldwide massacre that occurred in the year 2004. We tried to understand, because even with the massacre in 2004, despite pressure from the MPF, was the Federal Government unable to stop the illegal mining activity that takes place in that community? After that, field research was carried out to understand the current situation of mining in the community, and to verify as to the possibility of legalizing mining in the tribe, and if it becomes legalized, who should perform the mining, the Indians or third parties? Finally, it became clear that the legalization of mining and the compatibility of mineral exploration with the cultural and ethnic preservation of the Cinta Larga tribe is a subject with relative complexity, and the indigenous community must be heard in all steps, before deciding on legalization of diamond exploration.

Deux décennies d'extraction illégale de diamants sur leurs terres, perpétrée par des mineurs d'or, de plusieurs problèmes dans leurs relations avec le gouvernement fédéral et d'autres organes étatiques chargés de la protection juridique des droits légaux de cette communauté. Il cherche à comprendre la complexité qu'implique l'extraction de diamants dans l'histoire du peuple Cinta Larga jusqu'à la situation actuelle vécue par la communauté face à l'extraction de l'or. Il a été analysé, de manière ponctuelle, dix ans d'activité du ministère public fédéral, dans l'interstice de 2004 et 2013, dans l'exploitation minière illégale dans la communauté recherchée, après un massacre mondial survenu en 2004. Nous avons tenté de comprendre , parce que même avec le massacre de 2004, malgré la pression du MPF, le gouvernement fédéral n'a-t-il pas pu arrêter l'activité minière illégale qui a lieu dans cette communauté? Après cela, des recherches sur le terrain ont été menées pour comprendre la situation actuelle de l'exploitation minière dans la communauté, et pour vérifier la possibilité de légaliser l'exploitation minière dans la tribu, et si elle devient légalisée, qui devrait effectuer l'exploitation minière, les Indiens ou des tiers? Enfin, il est devenu clair que la légalisation de l'exploitation minière et la compatibilité de l'exploration minière avec la préservation culturelle et ethnique de la tribu Cinta Larga est un sujet d'une complexité relative, et la communauté autochtone doit être entendue à toutes les étapes, avant de décider de la légalisation de exploration de diamants.
