Nexo de causalidade em matéria de responsabilidade civil do Estado

Abstract

O presente trabalho tem por escopo o estudo do nexo de causalidade em matéria de responsabilidade civil do Estado, considerando a importância na qual se reveste, principalmente porque é a partir do nexo de causalidade que poderá advir a responsabilidade estatal, seja na modalidade objetiva ou subjetiva. No desenrolar do trabalho, será verificada a origem da responsabilidade civil do Estado e se incursionará pela evolução dessa matéria no Direito Administrativo brasileiro. Como forma de melhor esclarecimento da responsabilidade, buscarse-á adentrar nas teorias que embasam esse instituto, bem como verificar a situação atual na carta política que estrutura o ordenamento jurídico pátrio. Ainda, como forma de melhor esclarecer o tema, cabe tratar especificamente do nexo de causalidade em seus diferentes enfoques. Por derradeiro, tendo as noções da que embasam o desenvolvimento do tema, buscarse-á trazer situações do uso cotidiano, com a análise de jurisprudência aplicável ao caso.

The present work has as its scope the study of the causal nexus in the State civil liability, considering the importance in which it is, mainly because it is from the causal nexus that may come the state responsibility, either in the objective or subjective modality. In the course of the work, the origin of the civil liability of the State will be verified and the evolution of this matter in the Brazilian Administrative Law will be investigated. As a way to better clarify the responsibility, it will seek to enter into the theories that underlie this institute, as well as to verify the current situation in the political charter that structures the homeland legal system. Still, as a way of clarifying the subject, it is necessary to deal specifically with the causal nexus in its different approaches. Finally, having the notions that underlie the development of the theme, we will seek to bring situations of daily use, with the analysis of case law applicable.
