Magistrados assessores no Supremo Tribunal Federal : trajetórias, conexões e composições - período de 2010 a 2018

Abstract

O presente trabalho é uma pesquisa sobre os magistrados assessores do Supremo Tribunal Federal, que tem como objetivo geral investigar a composição dos gabinetes dos ministros do STF a partir de um banco de dados dos magistrados assessores trazendo à discussão o perfil da assessoria especializada nos gabinetes da Suprema Corte. O objetivo específico da pesquisa visa explorar e identificar semelhanças entre o perfil dos ministros e o perfil dos magistrados assessores. Para cumprir os objetivos propostos traz-se uma revisão da literatura, evidenciando as principais discussões sobre o Supremo Tribunal Federal, dividida em cinco partes. Em seguida, observa-se os perfis dos ministros da Corte, dos magistrados brasileiros e de algumas carreiras de assessores na burocracia brasileira para, na sequência mostram-se os achados. Utilizou-se no método de análise variáveis categóricas relacionadas ao perfil de grupo estudado, observando a passagem por universidades, tribunais e cargos ocupados pelos ministros e magistrados assessores, delineando trajetória e fazendo uso de categorias de análise. Para a construção do banco de dados dos magistrados assessores foram pesquisadas, no Diário Oficial da União, todas as portarias com menção aos juízes instrutores e auxiliares da Corte, permitindo a construção de um quadro que possibilita a identificação de informações para o perfil dos magistrados assessores, assim como a tabulação e análise dos dados por meio do software SPSS. Como resultado obteve-se uma descrição do perfil dos magistrados assessores que inclui: tempo de permanência; gênero; região e justiça (federal ou estadual) de origem; bem como a sua mobilidade entre os gabinetes de ministros. Os resultados estatísticos também incluem associações entre a região de origem dos ministros e a região dos magistrados assessores, assim como a associação entre a justiça à que pertencem os magistrados assessores e a justiça de maior atuação do ministro.

The present work is a research on the magistrates advisers of the Federal Supreme Court, which has as general objective to investigate a composition of the cabinets of the STF ministries from a database of magistrates advisers bringing to the discussion the profile of the Specialized assistance in the offices of the Supreme Court. The specific objective of the research is to explore and identify similarities between the profile of ministers and the profile of assistant magistrates. To fulfill the proposed objectives, a literature review is carried out, highlighting the main functions on the Federal Supreme Court, divided into five parts. Then, the profiles of the Court ministers, Brazilian magistrates and some careers of advisers in the Brazilian bureaucracy are observed, followed by the findings. Categorical variables related to the group profile were used in the method of analysis. studied, observing a passage through universities, courts and charges occupied by ministers and assistant magistrates, outlining a trajectory and making use of categories of analysis. For the construction of the database of the assistant magistrates, all ordinances with mention of the instructor and auxiliary judges of the Court were searched, in the Official Gazette of the Union, allowing the construction of a framework that allows the identification of information for the profile of the assistant magistrates, as well as the tabulation and analysis of data through the SPSS software. As a result, a description of the profile of the assistant magistrates was obtained, which includes length of stay; gender; region and justice (federal or state) of origin; as well as its mobility between cabinets of ministers. The statistical results also include associations between the region of origin of the ministries and a region of the assistant magistrates, as well as an association between the justice to which the assistant magistrates belong and the justice with the greatest role of the minister.
