Limites e potencialidades da judicialização como ferramenta de efetivação do direito à saúde no Brasil

Abstract

O presente trabalho almeja analisar o fenômeno da judicialização do Direito à Saúde, a fim de entender quais são seus limites e potencialidades como ferramenta de efetivação do direito à saúde. Para este fim, no primeiro capítulo será feita uma análise da transformação histórica dos direitos fundamentais e a exigibilidade dos Direitos Sociais, abordaremos também a concretização do direito à saúde, analisando políticas públicas com foco no SUS e na assistência farmacêutica. Após, no terceiro capítulo, adentraremos o tema central deste trabalho, a judicialização da saúde, onde a definiremos, e também abordaremos a reivindicação de medicamentos por via judicial. No quarto e último capítulo, refletiremos sobre os limites e potencialidades da judicialização do direito à saúde como instrumento de efetivação dos direitos sociais. Por fim, apresentaremos nossas considerações finais quanto ao tema.

This work aims to analyze the phenomenon of the judicialization of the Right to Health, in order to understand what are its limits and potentialities as a tool for the concretization of the right to health. To this end, in the first chapter will be made an analysis of the historical transformation of Fundamental Rights and the enforceability of Social Rights, we will also address the realization of the right to health, analyzing public policies focusing on SUS and pharmaceutical assistance. Afterwards, in the third chapter, we will enter into the central theme of this work, the judicialization of health, where we will define it, and we will also address the claim of medicines through the courts. In the fourth and last chapter, we will reflect on the limits and potentialities of the judicialization of the right to health as an instrument for the realization of social rights. Finally, we will present our final considerations on the topic.
