Contribuições da lei 14.133/2021 para a eficiência do processo licitatório da prefeitura municipal de Porto Alegre

Abstract

A sanção da Lei 14.133/2021, de Licitações e Contratos Administrativos, provocou novas discussões acerca do tema licitatório, especialmente no que se refere às melhorias que a nova legislação proporcionará. Nesta monografia, procurou-se entender a contribuição dessa norma ao processo licitatório da Prefeitura Municipal de Porto Alegre, para esclarecer a contribuição processual da nova legislação e quais relações se estabelecem com a melhoria de eficiência para o município. O estudo é introduzido por uma delimitação do tema que apresenta lacunas da legislação atual. A descrição do processo da Prefeitura de Porto Alegre, a comparação entre legislações e a análise das possíveis melhorias possibilitou identificar como a nova legislação poderá impactar no processo de compras. Os resultados demonstraram que, apesar de não haver uma ruptura com os fundamentos das normas anteriores, a Lei 14.133/2021 proporciona melhorias na eficiência do processo licitatório da organização estudada.

The sanction of new Brazilian’s Law of Bidding Process and Administrative Contracts provoked new discussions about the improvements that the new legislation could provide. In this monography, we try to understand the contribution of this law to the public purchase process of the Municipality of Porto Alegre The study is introduced by a delimitation of the theme that presents gaps in current legislation. The description of the process of the Municipality of Porto Alegre, the comparison between legislation and the analysis of possible improvements made it possible to identify how the legislation can impact the bidding process. The results showed that, even though the new legislation doesn’t break with the fundaments of previous rules, the Law 14.133/2021 provides improvements to the efficiency of the bidding process analyzed.
