A violência moral contra a mulher praticada pelo ex-companheiro no âmbito virtual

Abstract

Este trabalho tem como objetivo analisar a violência moral contra a mulher praticada pelo ex-companheiro no âmbito virtual. Trata-se de violência doméstica cometida no espaço virtual e, por isso, recebe o amparo pela Lei Maria da Penha (Lei 11.360/2006), levando em conta a existência de vínculo preexistente entre a vítima e o sujeito ativo. O respectivo trabalho visa a responder quais são os mecanismos presentes na legislação penal e extravagante voltados à proteção da mulher vítima de violência moral na internet (redes sociais/mídias sociais) e em que medida tais institutos de proteção são suficientes para coibir a prática dos crimes contra a honra da mulher, bem como para evitar que ocorra uma nova inserção da mulher no ciclo de violência doméstica. Para tanto, realizou-se o levantamento bibliográfico, pesquisa legislativa, jurisprudencial e análises de dados. Os resultados indicam que a violência moral com motivação de gênero na internet não é tratada com seriedade, devido a insuficiência na divulgação dos procedimentos e medidas cabíveis. Além disso, foi constatado que a falta de medidas de proteção e a impunidade dos agressores são fatores que contribuem para a banalização desse tipo de violência. Portanto, entende-se a necessidade de que sejam implementadas medidas efetivas à prevenção da violência doméstica na internet, bem como sejam realizadas campanhas informativas de combate à violência moral contra a mulher.

This work aims to analyze the moral violence against women practiced by the ex-partner in the virtual environment. This is domestic violence committed in the virtual space and, therefore, is supported by the Maria da Penha Law (Law 11.360/2006), taking into account the existence of a pre-existing bond between the victim and the active subject. The respective work aims to answer what are the mechanisms present in criminal and extravagant legislation aimed at protecting women who are victims of moral violence on the internet (social networks / social media) and to what extent such protection institutes are sufficient to curb the practice of crimes against the woman's honor, as well as to prevent a new insertion of women in the cycle of domestic violence. To this end, a bibliographical survey, legislative and jurisprudential research and data analysis were carried out. The results indicate that gender-motivated moral violence on the internet is not treated seriously, due to insufficient disclosure of procedures and appropriate measures. In addition, it was found that the lack of protective measures and the impunity of the aggressors are factors that contribute to the trivialization of this type of violence. Therefore, it is understood that there is a need to implement effective measures to prevent domestic violence on the internet, as well as to carry out information campaigns to combat moral violence against women.
