Animais (S)em direito : uma análise discursiva dos sentidos jurídicos de animal

Abstract

O presente trabalho de conclusão de curso tem como intenção analisar o texto legal da Resolução n° 1.236/2018 publicado pelo Conselho Federal de Medicina Veterinária (CFMV), que tem por função definir os conceitos de crueldade, abuso e maus-tratos contra animais, além de dispor sobre a conduta dos profissionais da medicina veterinária e da zootecnia. A análise consiste em uma interpretação do discurso da Resolução, embasada nas práticas teóricas e analíticas da Análise Materialista do Discurso (AD) proposta por Michel Pêcheux ao final da década de 1960. O trabalho investiga o funcionamento da prática da ideologia jurídica que se materializa na língua. Para isso, a análise articulou os conceitos de ideologia, discurso, função e funcionamento, acontecimento jurídico, Direito e sujeito, tendo como base principal os trabalhos de Pêcheux, Louis Althusser, e Eni Orlandi. No entrelaço de todos esses conceitos, os sentidos tomam corpo, indicando que os animais, para o Direito e para a ideologia jurídica, não passam de um objeto passivo e manipulado (e manipulável). Ademais, os animais são objetos para o ser humano, pois este é o único que poderia ter direito no discurso do Direito.

This final paper aims to analyze the legal text of the Resolution n° 1.236/2018 published by the Federal Council of Veterinary Medicine (CFMV), that has the intention of defining the concepts of cruelty, abuse and maltreatment against animals, apart from regulating the conduct of Veterinary Medicine and Zootechnics professionals. The analysis consists of an interpretation of the Resolution discourse, based on the theoretical and analytical practices of the Materialistic Discourse Analysis (AD) created by Michel Pêcheux by the late decade of 1960. The paper investigates the ways of functioning of the juridical ideology practice which materializes itself in the language. In order to do so, the analysis articulates the concepts of ideology, discourse, function and functioning, juridical event, Law and subject, having as reference the works of Pêcheux, Louis Althusser and Eni Orlandi. Through the articulation between all these concepts, the meaning/signification takes form by indicating that the animals are mere passive and manipulated (and manipulable) objects to the Law and the juridical ideology. Moreover, the animals are objects to the human being for the latter is the only one that could possibly have rights in the Law discourse.
