A inconstitucionalidade por vício de decoro parlamentar

Abstract

A presente monografia visa examinar a suposta inconstitucionalidade por vício decorrente de quebra de decoro parlamentar, especificamente nos casos de recebimento de vantagens indevidas, como compra e venda de voto para aprovação de leis ou atos normativos. Ainda, faz um breve relato histórico sobre a evolução do controle de constitucionalidade no Brasil, para que possa ter uma compreensão maior sobre o tema principal. Este estudo caracteriza-se por ser exploratório e bibliográfico, cujos dados foram coletados por meio de fontes secundárias, o trabalho foi dividido em tópicos onde demonstra inicialmente como o sistema de constitucionalidade foi inserido no ordenamento jurídico brasileiro, mostrando um aperfeiçoamento dos sistemas das Constituições anteriores na Carta Magna de 1988, que está em vigor desde então. Após, delimita-se, no tema principal demonstrando os últimos casos de corrupção onde ocorreram compra e venda de votos, e uma análise sobre a possível inconstitucionalidade de vício por quebra de decoro parlamentar.

This monograph aims at examining the alleged unconstitutionality due to a breach of parliamentary decorum, specifically in cases of receiving undue advantages, such as buying and selling votes for the approval of laws or normative acts. Also, it gives a brief historical account on the evolution of the control of constitutionality in Brazil, so that it can have a greater understanding on the main theme. This study is characterized by being exploratory and bibliographic, whose data were collected through secondary sources, the work was divided into topics where it initially demonstrates how the constitutional system was inserted in the Brazilian legal system, showing an improvement of the systems of previous Constitutions in the 1988 Constitution, which has been in force since then. Afterwards, it is delimited, in the main theme demonstrating the last cases of corruption where there were purchase and sale of votes, and an analysis on the possible unconstitutionality of vice for breach of parliamentary decorum.
