Tráfico de animais silvestres no contexto normativo brasileiro : uma análise de casos relevantes

Abstract

A presente pesquisa propõe-se a estudar as principais características a respeito do que se compreende como tráfico de animais silvestres, especialmente na região em que está localizada a Floresta Amazônica, uma vez que esta guarda um patrimônio ambiental inestimável e que vem a ser muito visado por traficantes. Dessa forma, a intenção do presente trabalho é analisar a maneira por meio da qual os instrumentos legais existentes são aplicados no enfrentamento dessa prática, amparados em trecho específico da Lei de Crimes Ambientais. Desssa forma, far-se-á levantamento bibliográfico com diversas fontes de informação que transitaram do âmbito especificamente acadêmico ao jornalístico, uma vez que tais questões encontram interesse popular. Além disso, destacar-se-á casos emblemáticos sobre o tema, os quais foram abordados em matérias veiculadas pela mídia hegemônica. Portanto, buscar-se-a revelar o status quo vinculado a essa atividade ilegal, a fim de propor eventuais melhorias no que tange à legislação vigente. Cuida-se de assunto do interesse não apenas das Autoridades Brasileiras, uma vez que tais questões ambientais concernem a todas as nações, pois os impactos dessas ações reverberam para além das fronteiras nacionais.

In short, the present research proposes to be a thorough study of an investigative nature in which some of the main characteristics are presented regarding what is understood as trafficking in wild animals, which devastates the four regions that make up the Brazilian state, especially the region in which the Amazon rainforest is located, as it holds an invaluable environmental heritage and is highly targeted by this type of trafficker. Therefore, the intention of this work is to analyze the way in which existing legal instruments are applied to fully combat this practice, supported by a specific section of the environmental crimes law, which is registered as Law 9,605, of February 12, 1998. It is noteworthy that for this purpose a broad bibliographical survey was carried out, supplied with various sources of information that moved from the specifically academic to the journalistic scope since such issues are of particular popular interest, in this way prominent cases were also described which were addressed in articles published by the hegemonic media. Therefore, the aim is to reveal the status quo linked to this illegal activity, with the aim of proposing possible improvements in current legislation regarding this particular subject, which, as explained during the development, deals with a subject that is of interest not only to the Brazilian authorities, since such environmental issues concern all nations as the impacts of these actions reverberate beyond the imaginary demarcated borders.
