Danos causados por machine learning : estudo doutrinário sobre a (im)possibilidade de responsabilização objetiva à luz do parágrafo único do art. 927 do Código Civil brasileiro

Abstract

A inteligência artificial está presente em diversos sistemas, com aplicação nos mais variados setores e contextos sociais, cujo uso pretende a aceleração de processo e maximização de resultados. Com o intuito de aprimorar o uso da inteligência artificial, passa-se a empregar o aprendizado de máquina (machine learning), que permite aos sistemas tomarem decisões com autonomia em relação à sua programação inicial e independente de interferência humana, gerando certo grau de imprevisibilidade dos resultados de sua ação. Assim como existem inúmeros benefícios no uso de sistemas de inteligência artificial dotados de machine learning, proliferam debates jurídicos a respeitos dos riscos existentes no uso desses sistemas. Nessa conjuntura, a presente monografia tem por objeto central investigar se é possível, com base na doutrina brasileira, a aplicação do regime objetivo de responsabilidade pelo emprego de machine learning, em virtude do conceito de risco contido no parágrafo único do art. 927 do Código Civil Brasileiro. A metodologia do estudo baseia-se na consulta e análise de produções bibliográficas sobre inteligência artificial e responsabilidade civil, bem como utiliza os métodos dedutivo e indutivo para alcançar o objetivo do trabalho. Ao fim da investigação, constata-se certa convergência doutrinária apontando que os danos ocasionados pelo emprego de machine learning sejam reparados de acordo com o dispositivo mencionado, pois o machine learning possui potencialidade lesiva e o seu emprego representa riscos inerentes e especiais de ocasionar danos.

Artificial intelligence is present in several systems, with application in the most varied sectors and social contexts, whose use intends to accelerate processes and maximize results. In order to improve the use of artificial intelligence, machine learning is being used, which allows systems to make autonomous decisions in relation to their initial programming and independent of human interference, generating a certain degree of unpredictability of the results of their actions. Just as there are numerous benefits in the use of artificial intelligence systems equipped with machine learning, legal debates proliferate regarding the risks existing in the use of these systems. In this conjuncture, the central purpose of this monograph is to investigate whether it is possible, based on Brazilian doctrine, to apply the objective regime of liability for the use of machine learning, due to the concept of risk contained in the sole paragraph of article 927 of the Brazilian Civil Code. The monography’s methodology is based on the consultation and analysis of bibliographic productions about artificial intelligence and civil liability, as well as uses the deductive and inductive methods to achieve its objective. At the end of the investigation, it is observed a certain doctrinal convergence pointing out that the damages caused by the use of machine learning should be compensated according to the mentioned article, because machine learning has harmful potentiality and its use represents inherent and special risks of causing damages.
