Partidos políticos e sua tarefa de formação da vontade política do Estado : delimitação, evolução e constitucionalização

Abstract

Este trabalho propõe-se a analisar os partidos políticos sob o ponto de vista jurídicoconstitucional não-positivista, abordando como enfoque principal a constitucionalização como reconhecimento de sua tarefa principal de cooperar para formação da vontade política do estado. O método utilizado é o lógico-dedutivo, e a pesquisa, bibliográfica e jurisprudencial. O estudo mostra-se relevante, porque os partidos políticos são instituições essenciais para o desenvolvimento e aprimoramento constante do regime democrático, desempenhando importantes funções dentro da sociedade e do estado, uma vez que são elos intermediários que ligam a sociedade ao seu corpo político, possibilitando a comunicação e o compasso entre eles. O trabalho foi dividido em três capítulos: introdução ao tema, o papel dos partidos políticos na sociedade como agentes de formação da vontade política e a constitucionalização dos partidos políticos como reconhecimento da tarefa de cooperar para a formação da vontade política. Inicialmente, delimita-se o tema e faz-se uma análise da evolução dos partidos políticos no mundo e no Brasil. Após, discutem-se as principais funções dos partidos políticos, entre elas, a principal sendo a de cooperar para a formação da vontade política. Por fim, analisam-se os efeitos da constitucionalização dos partidos políticos, dentre os quais está o principal de reconhecer juridicamente um papel que eles já desempenhavam na prática: cooperar para formação da vontade política. Ainda, analisa-se a relação entre os partidos políticos, o parlamento e o STF, e em que medida o constitucionalismo discursivo pode ser neles implementado.

This study proposes to examine the political parties from the legal and constitutional nonpositivist point of view, addressing as its primary focus the constitutionalization in recognition of their primary task of cooperating in the formation of political will of the state. The method used is the logical-deductive, and the research, based on literature and jurisprudence. The study happens to be relevant, because political parties are essential institutions for the development and constant improvement of the democratic system, playing important roles in society and state, since they are intermediate links that bind the society to its political body, enabling communication and the compass among them. The work was divided into three chapters: introduction to the subject, the role of political parties in society as agents of formation of political will, and the constitutionalization of political parties in recognition of the task of cooperating in the formation of political will. Initially, the subject is delimited and an analysis of the evolution of political parties in the world and in Brazil is traced. After, the main functions of political parties are discussed, among them the principal being to cooperate in the formation of political will. Finally, the effects of the constitutionalization of political parties are analyzed, among which the central is to juridically recognize a role they have played in practice: to cooperate in the formation of political will. Still, the relationship between political parties, parliament and the Supreme Court is explored and to what extent the discursive constitutionalism can be implemented into them.
