O presente trabalho versa sobre a aplicabilidade do Princípio da Insignificância ao delito de furto pelo Supremo Tribunal Federal. Observa-se que o furto simples é uma conduta tipificada no artigo 155 do Código Penal, com pena cominada de um a quatro anos de reclusão. Ainda que essa reprimenda seja relativamente baixa, quando se analisam os dados sobre aprisionamento, localizados no Levantamento Nacional de Informações Penitenciárias – INFOPEN, percebe-se que esse delito é o quinto dentre os responsáveis por maior índice de encarceramento no Brasil. Para entender essa falta de correspondência entre a legislação penal e sua aplicação prática, o presente trabalho se propôs a analisar a realidade operacional do sistema penal brasileiro, pelo viés criminológico crítico – escolheu-se o referido tribunal pelo fato do mesmo ter sido o precursor na delimitação de requisitos para a aplicação do Princípio da Insiginificância. Após pesquisa jursprudencial sobre o tema referido, a percepção é a de que o sistema atual é controvertido em si mesmo e seletivo, refletindo, inclusive, na função de princípios que atuam justamente como limitadores do poder punitivo, no caso desta pesquisa, o princípio da bagatela. Essa abordagem problemática pelos ministros do STF justifica crer na positivação do princípio no anteprojeto do Código Penal, meio esse necessário para se alcançar racionalidade, segurança jurídica e, acima de tudo, realização da justiça na seara penal. ...

This research focus on analyze the applicability of the Principle of Insignificance to the crime of theft by the Federal Supreme Court. It is observed that simple theft is a conduct typified in article 155 of the Penal Code, with a penalty commenced from one to four years of imprisonment. Although this reprimand is relatively low, when analyzing the data on imprisonment, located in the National Survey of Penitentiary Information - INFOPEN, it is perceived that this crime is the fifth among those responsible for the highest rate of incarceration in Brazil. In order to understand this lack of correspondence between the criminal law and its practical application, the present article set out to analyze the operational reality of the Brazilian penal system, by the critical criminological lens – the Federal Supreme Court was chosen because it was the forerunner in requirements for the application of the Principle of Insignificance. After a jursprudential research on the subject, the perception is that the current system is controversial in itself and selective, reflecting even in the function of principles that act precisely as limiting the punitive power – including the principle object of this research. This problematic approach by the ministers of the Supreme Court leads to a legislative solution: include the principle and its requirements in the preliminary draft of the Penal Code, in order to achieve rationality, legal security and, above all, criminal justice. ...
