As edificações do sistema de justiça em Porto Alegre : a expansão do campo judicial na perspectiva da geografia jurídica

Abstract

Este trabalho pretende contribuir para o debate sobre a problemática das interrelações entre as instituições do campo judicial e a produção do espaço urbano. Trata-se de uma pesquisa sociojurídica, ancorada na perspectiva da geografia jurídica, que enfoca o papel do direito na produção das edificações das instituições do sistema de justiça na cidade de Porto Alegre. O objetivo é responder a seguinte pergunta: por que há uma concentração de edificações das instituições do sistema de justiça em uma região tão privilegiada da cidade de Porto Alegre, o bairro Praia de Belas? Reabrindo um diálogo entre a teoria da produção do espaço de Henri Lefebvre e a teoria dos campos sociais de Pierre Bourdieu, foi possível chegar à hipótese de que a expansão do campo judicial ocorrida no Brasil após a promulgação da Constituição Federal de 1988 está relacionada com a concentração de edificações do sistema de justiça em uma área econômica e simbolicamente valorizada da cidade, às margens do Lago Guaíba. Com efeito, a investigação empírica realizada, a partir de uma estratégia de pesquisa documental, sugere que a inscrição de edificações monumentais em uma localização privilegiada materializa no tecido urbano da cidade o poder simbólico das instituições do campo judicial, dentro e fora do campo jurídico, no Brasil contemporâneo. No entanto, os dados empíricos revelam que isso foi possibilitado por um política pública de reserva de uso de terras nesta área favorecendo as necessidades da administração pública. Originalmente, esses imóveis foram destinados pelos planos diretores de desenvolvimento urbano à atração de centros administrativos estaduais e federais; porém, com a acelerada expansão do campo judicial, ao invés de servirem às necessidades do Poder Executivo, acabaram sendo destinados ao Poder Judiciário e ao Ministério Público.

This work aims at contributing to the debate on the interrelations between the institutions of the judicial field and the production of urban space. This is a socio-legal research, anchored in the perspective of legal geography, which focuses on the role of law in the production of the buildings of the justice system institutions in the city of Porto Alegre. The objective is to answer the following question: why is there a concentration of buildings of the justice system institutions in such a privileged region of the city of Porto Alegre, the Praia de Belas neighborhood? By reopening a dialogue between Henri Lefebvre’s theory of the production of space and Pierre Bourdieu’s theory of the social fields, it was possible to come to the hypothesis that the expansion of the judicial field in Brazil after the promulgation of the Federal Constitution of 1988, is related to this concentration of buildings of the justice system in an economically and symbolically valued area of the city, on the banks of the Guaiba Lake. Indeed, the empirical investigation carried out, based on a documental research strategy, suggests that the inscription of monumental buildings in a privileged location materializes in the urban fabric of the city the symbolic power of the institutions of the judicial field, inside and outside the legal field, in contemporary Brazil. However, empirical data also reveals that it was made possible by a land-use reserve policy in this area favoring public administration needs. Originally, these public properties were destined by the master plan of urban development to the attraction of state and federal administrative centers; however, with the accelerated expansion of the judicial field, instead of serving the needs of the executive branch, they were destined to the Judiciary and the Public Prosecutor' s Office.
