A elaboração do código do processo penal do Estado do Rio Grande do Sul (1898) : entrelaçamentos jurídicos e traduções culturais na primeira República

Abstract

Analisar-se-á nesta pesquisa a Codificação do Processo Penal do Estado do Rio Grande do Sul ocorrida na Primeira República, continuando a linha de investigações acerca das legislações, cultura e prática jurídica daquele período. Este trabalho foi iniciado na Pós-Graduação em Direito da UFRGS entre 2014 e 2016, na sequencia de pesquisas acerca das competências Estaduais na constituição republicana de 1891. Passado o debate acerca da competência da legislação estadual na matéria de organização da justiça e direito processual, investiga-se neste ensaio como foi realizado o processo de Codificação estadual do Processo Penal no estado do Rio Grande do Sul, precedido pelas leis orgânicas da magistratura, da polícia, dentre outras legislações estaduais rio-grandenses, para responder acerca de como surgiram, circularam e foram trabalhadas estas fontes e ideias jurídicas pelos juristas que codificaram a legislação gaúcha, e também quanto aos foram os possíveis fatores culturais que influenciaram essa codificação. Para empreender esta análise, observou-se a literatura da metodologia na pesquisa histórica, que atesta uma importância do contato e investigação nas fontes primárias. Desta forma os escritos legislativos, doutrinários, jurisprudenciais, ofícios e periódicos de época foram utilizados para caracterizar o período em que ocorreu a codificação, conforme o contexto da própria época, consubstanciada em um momento de entrelaçamento jurídico, possibilitado pela tradução cultural e ressignificação conceitual. Concluiu-se que o processo legislativo de criação do CPPRS foi marcado por estes momentos de ressignificação conceitual, operacionalizado através de agentes políticos e culturais.

In this research, we shall analyze the Code of Criminal Procedure of Rio Grande do Sul in the time of the Brazil’s First Republic, in a series of legal history researches about enacted law, culture and legal Praxis of that era. This essay was developed in the Master in Laws postgraduate degree of the Federal University of Rio Grande do Sul, from 2014 to 2016, particularly on complementary research of the States’s prerogatives safeguarded by 1891 republican constitution. Settled the debate about the state’s prerogative of legislation concerning matters such as the judiciary and procedural law, in this essay we shall research the drafting of the Rio Grande do Sul’s Code of criminal procedure. It was preceeded by the magistrate’s and police’s organic code, among other state legislation, in order to answer how did these legal sources and concepts were created, their dissemination, and their adaptation by the jurists that helped codify the legislation, along with the possible cultural factors influencing the drafting of the code. In order to undertake this analysis, we have observed historical methodologies, stating great importance to the primary source investigation. Applying these methodologies to the research, the legal writings, legal doctrine, legal precedents, State official paper works and newspapers from that time were used as important sources, helping to determine the Code’s creation scenario, accordingly to the context of that age, drafted in a moment of legal entanglements, and made possible by legal translation and conceptual resignification. We concluded that the drafting of the CPPRS was heavily influenced by these moments of cultural resignification, and by the intervention of political and cultural agents.
