O direito á terra aos povos indígenas e a burocratização do procedimento demarcatório : uma análise do caso da Retomada Multiétnica Gãh-ré - Kaingang e Xokleng

Abstract

O presente trabalho apresenta uma análise acerca do direito à terra aos povos indígenas a partir da análise de um caso concreto: a Retomada Indígena Multiétnica Kaingang e Xokleng. Relacionando o atraso às demarcações territoriais à alta burocratização do procedimento demarcatório vigente no ordenamento jurídico brasileiro. Sendo assim, busca compreender os reais entraves na negligência Estatal sobre a efetivações desses direitos já expressos na Constituição Federal de 1988. Para isso, abordará além do caso concreto, o histórico de legislação indigenista, a trajetória e aumento progressivo da burocratização do procedimento demarcatório e a relação e importância desse povo com o tema terra. Por fim analisará a divergência e oposição de dois modos de sistemas, econômicos políticos e sociais, o indígena e o não indígena. Descobrindo que o reconhecimento de cosmovisões diversas da imposta pelo sistema capitalista, põe em risco interesses considerados maiores, do que a vida e continuidade de diversos povos.

This work presents an analysis of the right to land for indigenous peoples based on the analysis of a specific case, the multi-ethnic indigenous recovery of Kaingang and Xokleng. Relating the delay in territorial demarcations to the high bureaucratization of the demarcation procedure in force in the Brazilian legal system. Therefore, seeking to understand the real obstacles to state neglect on the implementation of these rights already expressed in the Federal Constitution of 1988. To this end, it will address, in addition to a specific case, the history of indigenous legislation, the trajectory and progressive increase in the bureaucratizati on of the demarcation procedure and the relationship and importance of these people with the land issue. Finally, it will analyze the divergence and opposition of two systems, political economics and social ones, indigenous and non-indigenous. Accordingly, the recognition of worldviews different from those imposed by the capitalist system puts at risk interests considered greater than the life and continuity of different people.
