Legalidade e excessos na regulação da liberdade de expressão no Brasil

Abstract

Este trabalho investiga os marcos legais e as práticas judiciais relacionadas à regulação da liberdade de expressão no Brasil, focando no impacto dessas medidas sobre os direitos fundamentais, o estado de direito e os princípios democráticos. A metodologia inclui a análise dos fundamentos contrários e favoráveis à censura e do panorama histórico de tais restrições no país; estudo de casos específicos, com a avaliação das justificativas legais e dos possíveis excessos na regulação do discurso online. Deu-se atenção especial a instâncias como o Inquérito das Fake News de 2019, a regulação da informação durante a pandemia de COVID-19, as eleições presidenciais de 2022 e os caso Twitter Files Brazil em 2024. Os resultados sugerem que, embora os esforços legislativos tenham como justificativa a proteção da integridade democrática e a ordem pública, muitas vezes acabam infringindo os direitos individuais. Esta pesquisa contribui para o debate contínuo sobre os limites da intervenção estatal na comunicação digital e o papel da supervisão judicial na proteção das liberdades civis.

This paper investigates the legal frameworks and judicial practices related to regulating freedom of expression in Brazil, focusing on the impact of these measures on fundamental rights, the rule of law and democratic principles. The methodology includes bibliographic research, analyzing the arguments for and against censorship and the historical context of such restrictions in the country; and specific case studies, to evaluate the legal justifications and potential excesses in regulating online discourse. Special attention was given to instances such as the 2019 Fake News Inquiry, the regulation of information during the COVID-19 pandemic, the 2022 presidential elections, and the 2024 Twitter Files Brazil. The results suggest that although legislative efforts are justified by protecting democratic integrity and public order, they often infringe on individual rights. This research contributes to the ongoing debate on the limits of state intervention in digital communication and the role of judicial oversight in protecting civil liberties.
