A modulação de efeitos temporais na jurisdição constitucional : pressupostos, técnica e aplicação no controle concentrado

Abstract

A partir da síntese da noção da morfologia política do Estado, representada pela maturação histórica da hexapartição de poderes, da essencialidade do controle de constitucionalidade enquanto tutela de valores últimos e a reportagem dos dois modelos clássicos, no seio da Jurisdição Constitucional, tema que ainda suscita discussão é o da modulação de efeitos temporais nas declarações de inconstitucionalidade, uma vez que dialoga tanto com a intransigibilidade da supremacia da Constituição como com a ponderação casuística de normas de igual status constitucional. A técnica, desde sua influência estrangeira, seu processo legislativo, natureza e constitucionalidade, até os critérios formais e valorativos de ordem material para determinação dos efeitos na modulação temporal, bem como o empirismo da técnica, voltado ao exaurimento da pesquisa jurisprudencial e o exame pontual da adoção da modulação exclusivamente pro futuro pelo Supremo Tribunal Federal ao longo da vigência da faculdade legislativa da técnica da modulação de efeitos são o balizamento da análise científica a ser empreendida na presente dissertação de mestrado.

From the synthesis of the notion of the political morphology of the State, represented by the historical maturation of the hexapartition of powers, of the essentiality of the control of constitutionality as a guardianship of ultimate values and the reporting of the two classic models, within the Constitutional Jurisdiction, a theme that still raises discussion is the modulation of temporal effects in declarations of unconstitutionality, since it dialogues both with the intransigibility of the supremacy of the Constitution and with the casuistic consideration of norms of equal constitutional status. The technique, from its foreign influence, its legislative process, nature and constitutionality, to the formal and evaluative criteria of material order to determine the effects in the temporal modulation, as well as the empiricism of the technique, aimed at the exhaustion of the jurisprudential research and the punctual examination of the adoption of modulation exclusively for the future by the Federal Supreme Court during the validity of the legislative faculty of the technique of modulation of effects are the hallmark of the scientific analysis to be undertaken in this dissertation.
